Conditions of Tenancy
- 1. BOOKINGS:
- All bookings are accepted by the Agent in good faith but are subject to change or cancellation by the Landlord prior to the commencement of the booking.
- Upon receipt by the Agent of the reservation, the tenant confirming shall advise in writing the acceptance of these Conditions of Tenancy within 10 days of this date.
- If a cancellation occurs as a result of the actions of the Landlord of the property, clause 5 hereof willnot apply.
- If such a cancellation occurs the Agent will make reasonable attempts to secure alternative accommodation for the tenant. If no alternative accommodation can be secured, all monies paid by the tenant will be refunded.
- A reservation will be held by the Agent for no more than 10days whereby the deposit and acknowledgment of the Conditions of Tenancy have been received from the tenant.
- 2. DEPOSIT:
- The deposit is payable by the tenant to the Agent within 10 days of the date of the reservation being made, or as noted in the Acknowledgement Form. If the deposit is not received within 10 days, or as noted, the reservation will lapse.
- At the time of deposit being paid, the tenant shall acknowledge receipt of these Conditions of Tenancy and be bound by same.
- The deposit shall be $200, or 50% of the rental for the property, whichever is the higher amount.
- Full rent is required at time of making reservation for bookings of less than 7 days and for bookings made less than 30 days in advance.
- 3. BALANCE OF RENTAL:
- The balance of the rental for the accommodation will be paid to Dodd & Page Pty Ltd not less than 30 days prior to the commencement of the tenancy.
- If the balance is not paid 30 days prior to the commencement of the tenancy, the booking will lapse and the deposit will be forfeited.
- 4. METHOD OF PAYMENT:
- Cheques or money orders made payable to Dodd & Page Pty Ltd and posted to PO Box 3, Port Elliot SA 5212.
- Credit card payments and internet transfers can be accepted. (Visa and Mastercard). A surcharge of 1.95% which includes GST, will apply to all card transactions. (Contract cleaning payments cannot be accepted by credit card).
- 5. CANCELLATION:
- All cancellations by the tenant must be advised in writing to the Agent.
- If a cancellation is made prior to the commencement of the booking, all monies paid by the tenant in respect of the booking less an administration fee of $110.00.(inclusive of GST) will be refunded IF THE PROPERTY IS RE-LET FOR THE SAME PERIOD.
- NO money will be refunded if the property is NOT re-let for the same period.
- 6. DEPARTURE GUARANTEE (DG)
At the time of booking holiday accommodation Dodd & Page requires pre-authorisation to debit the tenant's CREDIT CARD with an amount to cover costs for any breakages, repairs, rubbish removal and/or extra cleaning, to a maximum of $300 - this is called a "Departure Guarantee".
This pre-authorised transaction will only be debited if the property is deemed to be left dirty, rubbish requires removal or repairs are required. No credit card surcharge will be levied on pre-authorised transactions.
The tenant's pre-authorisation will be effective for a period of 7 days following departure.
If the tenant does not have access to a credit card, a DG amount of $200 to $300 is to be lodged by cheque, money order or cash with Dodd & Page, no later than 10 days prior to arrival at the property. This amount will be refunded to the tenant by cheque, less any cleaning, rubbish removal, or repair costs, if so deemed, 7-10 days following departure.
7. OCCUPANCY:
(a) The tenant acknowledges that the said property is for private holiday use and NOT for commercial purposes, parties, receptions or the like.
(b) The tenant shall not permit more persons to reside in the property other than the number of persons booked on the date of reservation.
(c) The tenant shall not permit a tent, annexe, caravan or other temporary accommodation at the property during the tenancy.
8. KEYS:
(a) Tenants may enter the property after 2:00pm on the day the tenancy commences and must vacate the property before 10:00am on the day the tenancy ends.
(b) Keys for properties within the Victor Harbor, Port Elliot & Middleton areas - collect from Port Elliot office Keys for properties within the Goolwa & Hindmarsh Island areas - collect from Goolwa office. If keys cannot be collected within our holiday accommodation office hours, please contact the Port Elliot office prior to sending the required balance rent for alternate arrangements. Accommodation office hours for Port Elliot & Goolwa Monday -Friday 9a.m. - 5p.m. Saturday 9a.m. - 12 noon Closed all Public holidays and Sundays
(c) If keys are lost or misplaced by the tenant, the Agent reserves the right to charge a call-out fee for after hours attendances and for key replacements. Unforseen circumstances after hours may require a locksmith at the tenants expense. Proof of confirmed tenancy (ie receipt or Confirmation letter) together with payment for locksmith will be required. (Oops Security 0414 812 640)
9. TENANTS' OBLIGATIONS
- Dodd & Page holiday rentals are privately owned properties offering all furnishings, beds, kitchen utensils and cleaning equipment.
- The tenancy is conditional upon the tenant:
- Providing general security in and around the property during the said occupancy.
- Notifying the Agent of all breakages, damage, failure of electrical or plumbing equipment as soon as practicable. The cost of rectifying any such losses caused by the tenant may be charged accordingly (see "6. Departure Guarantee").
- Leaving the property in a clean and tidy manner and removing all rubbish, bottles, food and personal items. Any additional cleaning of the property may be charged at the tenant' expense.
- Please remember that all rubbish must be removed from the property on departure. There is a skip at the Port Elliot Office if you need that service. A fee will be charged if rubbish is left at the property.
- Securely locking the property at the time of departure and returning the keys forthwith to the Agent's office.
- Tenants shall supply all bed sheets, pillow cases, kitchen linen, towels and the like and all personal hygiene and cleaning requirements (sprays etc) including soap, toilet paper, detergents, cloths etc.
- NO domestic pets permitted on or about the property during the tenancy.
- Smoking is prohibited in all holiday rentals.
- A cleaning service at the tenants' expense is available subject to the availability of a contract cleaner. Bookings and payment for such a cleaning service are to be made approximately 7 days prior to departure. Payment for contract cleaning cannot be made by credit card.
